Julie C. Rising joined the Litigation Department at Berluti & McLaughlin LLC in 2010.  Ms. Rising previously worked at Choate, Hall & Stewart LLP in Boston, and Schiff Hardin LLP in Chicago,  where she was co-chair of the firm’s primary pro bono program. Ms. Rising has represented a variety of clients in litigation matters ranging from trademark protection and litigation, trade secret litigation, patent infringement litigation, government contract disputes, bankruptcy creditors’ rights, insurance and reinsurance litigation as well as white collar criminal investigations and a variety of business contract disputes.  She has appeared in both state and federal courts in Illinois and Massachusetts, and has extensive oral argument and deposition experience.  She also has experience with settlement negotiations and alternative methods of resolution, including mediation and arbitration. 

Ms. Rising is a member of the Illinois and Massachusetts Bars and is admitted to practice in the United States District Court for the District of Massachusetts, the First Circuit Court of Appeals, and the United States District Court for the Northern District of Illinois.  She is also a member of the American Bar Association, Boston Bar Association, and the Women’s Bar Association.

Ms. Rising received her Juris Doctor from the Law School at the University of Chicago in 2002, where she was the Symposium Editor of the University of Chicago Roundtable interdisciplinary journal, co-chair of the Women’s Mentoring Program, and the recipient of the Ann Watson Barber Outstanding Service Award for Exceptional Contributions to the Quality of Life at the Law School. She graduated with a Bachelor of Arts Degree with Distinction in the Major from the University of Wisconsin-Madison in 1993.

Ms. Rising lives in Cambridge, Massachusetts.

Representative Experience

Commercial Litigation:  Represented individuals and companies in wide-ranging disputes involving contracts, technology and software licenses, commercial leases, franchise agreements, and business torts.   Negotiated favorable settlement for a client seeking to enforce the terms of a large equipment lease against a lessee in default.

Trade Dress and Trade Secret Litigation:  Successfully represented client in an International Trade Commission case declaring numerous foreign companies were intentionally infringing the client’s trade dress by manufacturing counterfeit versions of its product.   

Trademark Prosecution and Litigation:  Assisted variety of clients in obtaining trademark protection for new products and/or new companies.  Represented multiple clients in intellectual property disputes involving the enforcement of trademark rights.  Represented international food manufacturer regarding comparative advertising on their packaging. 

Franchise Law:  Obtained injunction against a former dealer-licensee from infringing our client’s trademark.  Represented several national hospitality franchises involving enforcement of their trademark and trade dress rights against competitors.  

Patent Litigation:  Represented pharmaceutical and manufacturing companies in a variety of patent infringement suits.  

Domain Name Disputes:  Represented domain name holders in UDRP actions through the WIPO against cybersquatters, competitors, and phishers, obtaining infringing domain names for clients. 

Bankruptcy Litigation:  Represented creditors in litigation involving fraudulent asset transfers and debt prioritization.  Successfully defeated appeal of the lower court’s order that client was permitted to pursue state claims against certain defendants despite the filing of bankruptcy by their co-defendants.     

Insurance and Reinsurance Litigation:  Represented both insurers and insureds in litigations and arbitrations regarding interpretation of various terms of excess coverage policies and disputes over broker contracts.
