
Congratulations to Robert R. Berluti for securing a complete victory on behalf of his client in Suffolk Superior Court. After a multi-day trial, the jury returned a verdict in favor of the plaintiff on all three counts—Intentional Misrepresentation, Negligent Misrepresentation, and violation of Chapter 93A—against the seller of undeveloped real estate.
The case centered on the defendant’s failure to disclose that the property was contaminated with buried construction debris, tree stumps, and a cement foundation, rendering it partially unbuildable. The jury awarded nearly $400,000 in damages, before the application of multiple damages under Chapter 93A, which was reserved by the trial judge, and statutory interest.
An excellent result for a client who was misled into purchasing land that was fundamentally compromised—and a strong message that concealment and misrepresentation will not be tolerated.
